Order XIII :
Production, Impounding And Return Of Documents :
Rule 1 :
1.[Original documents to be produced at or before the settlement of issues :
(1) The parties or their pleader shall produce on or before the settlement of issues, all the documentary evidence in original where the copies thereof have been filed along with plaint or written statement.
(2) The Court shall receive the documents so produced:
Provided that they are accompanied by an accurate list thereof prepared in such form as the High Court directs.
(3) Nothing in sub-rule (1) shall apply to documents—
(a) produced for the cross-examination of the witnesses of the other party; or
(b) handed over to a witness merely to refresh his memory.]
State Amendment :
High Court Amendments-[Patna] :
In rule 1, after the words, "at the first hearing of the suit", add "or where issues are framed, on the day when issues are framed, or within such further time as the Court may permit".
[Punjab, Haryana and Chandigarh] :
Substitute sub-rule (1) as under:
"The parties or their pleaders shall produce at the first hearing of the suit all the documentary evidence of every description in their possession or power, either in original or photostat copy thereof, on which they intend to rely and which has not already been filed in Court, and all documents which the Court has ordered to be produced. "-(1-5-1975).
[N.B.-These High Court Amendments relate to the provisions as existed before the 1999 Amendment Act.]
